Bases legales del concurso “Muéstranos el territorio de Girona en bici y TRANSPYR COAST TO COAST

Identificación de la empresa organizadora

La empresa Anayet Sport Marketing con domicilio fiscal en Navarra y con CIF B31968068 ha organizado esta campaña titulada “Muéstranos el territorio  de Girona en bici y TRANSPYR COAST TO COAST.

Fechas de comienzo y finalización del concurso y ámbito geográfico

La fecha de inicio del concurso será el 9 de julio a las 9.00 horas y finalizará el día 31 de julio a las 24.00 horas. Se podrá participar sólo en ese período de tiempo.

La campaña está dirigida a los usuarios de la página Instagram de Transpyr Coast to Coast.

Anayet Sport Marketing se reserva el derecho a aplazar o ampliar el período del concurso en caso de fuerza mayor, así como la facultad de interpretar los presentes términos y condiciones legales.

Reglas y condiciones para participar

Podrán participar en el concurso aquellas personas físicas mayores de 18 años con residencia en Europa.

No podrán participar: empleados de la empresa, perfiles fraudulentos, expertos en concursos, etc.

La participación se realizará en dos fases. En la primera fase (del 9 al 24 de julio), para participar deberán colgar en Instagram o Facebook una fotografía donde aparezca una o varias personas en bicicleta por la provincia de Girona. Las fotos se deberán etiquetar con #transpyringirona y mencionar @Transpyr y @costabravapirineu.
En la segunda fase (del 25 al 31 de julio), se podrá votar cual es la mejor fotografía. Aquella fotografía que reciba más votos ganará un maillot Transpyr Gran Raid MTB. Entre el resto de participantes (fotógrafos y votadores) se sorteará el otro maillot.

Anayet Sport Marketing se reserva el derecho a efectuar cambios en la campaña durante su desarrollo, si se produjera alguna causa que impida llevarla a buen término o con el fin de mejorar su avance.

Selección del ganador y modalidad de sorteo

Los dos ganadores saldrán del recuento de votos y del sorteo que se realizará el día 2 de agosto ante el equipo de Transpyr Coast to Coast, que certificará que la selección ha sido aleatoria.

Los ganadores serán anunciados oficialmente en nuestra página y les enviaremos un mensaje personal. Si en el plazo de 5 días no han respondido, el premio pasará al siguiente (en votos o se realizará un nuevo sorteo), quien también tendrá 5 días para responder. Una vez se ofrezca el premio al suplente, el anterior ganador perderá el derecho a reclamar el premio. En caso de que no haya respuesta de los suplentes, se considerará desierto el premio.

Anayet Sport Marketing queda eximida de cualquier responsabilidad en caso de existir algún error en los datos facilitados por los ganadores / suplentes que impida su identificación.

Valor y naturaleza del premio ofrecido

El maillot GOBIK – Transpyr Coast to Coast tiene un precio de venta al público aproximado de 60 euros. El/La ganador/a las recibirá en el domicilio que indique.  Por otro lado, la fotografía del ganador/a se publicará en las redes sociales del Patronat de Turisme Costa Brava Pirineu de Girona.

Anayet Sport Marketing no se responsabiliza de las posibles pérdidas, deterioros, robos o cualquier otra circunstancia imputable a los servicios de mensajería que puedan afectar al envío de los premios.

Derecho de propiedad de las imágenes

Anayet Sport Marketing adquiere el derecho exclusivo, en el ámbito internacional y en cualquier medio sobre les imágenes ofrecidas por los participantes a la campaña.

Protección de datos de carácter personal

Los datos suministrados por los participantes serán tratados confidencialmente y recopilados en un fichero automatizado de datos de carácter personal, siendo la empresa Anayet Sport Marketing titular y responsable de dicho fichero, con el objetivo de:

  • Gestionar la participación de los concursantes y ponerse en contacto con ellos.
  • Comunicarles que han resultado ganadores del concurso.

Anayet Sport Marketing garantiza el cumplimiento íntegro de la Ley Orgánica 15/1999, de 13 de diciembre de Protección de Datos de Carácter Personal en el tratamiento de los datos personales recogidos en el concurso, en especial en lo que se refiere a la atención del ejercicio de los derechos de información, acceso, rectificación, oposición y cancelación de datos personales de los concursantes.

Penalizaciones en caso de uso fraudulento

Entenderemos como fraude el uso de plataformas o aplicaciones independientes para conseguir votos o más participaciones en el concurso, al igual que comportamientos que detectemos como aparentemente abusivos y/o malintencionados.

La constatación de cualquiera de estas prácticas supondrá la descalificación del concurso que consideremos que han llegado a través de vías no permitidas en la campaña.

Anayet Sport Marketing se reserva el derecho de emprender acciones judiciales contra aquellas personas que realicen cualquier tipo de acto susceptible de ser considerado como manipulación o falsificación del concurso.

Anayet Sport Marketing queda eximida de cualquier responsabilidad por daños y perjuicios que puedan deberse a la falta temporal de disponibilidad o de continuidad del funcionamiento de la aplicación mediante la que se participa en la promoción, a la defraudación de la utilidad que los usuarios hubieren podido atribuir a la misma y al acceso a las distintas páginas y envíos de respuestas de participación a través de Internet.

MANDATORY SPORTS INSURANCE AND MEDICAL SERVICE – Transpyr C2C

COMPULSORY INSURANCE INCLUDED WITHIN THE PARTICIPATING PACK

The registration to TRANSPYR COAST TO COAST 2019, either in GRAND RAID MTB, BACKROADS and other modalities, includes for each individual participant the sports insurance in matters of accidents and civil liability that are by law mandatory to take part in a cycling event like this.

COVERAGE: These insurances cover the development of the cycling activity, so in a stage event like TRANSPYR COAST TO COAST it is important to highlight that its scope of action and validity is limited to the course of each stage, since the start of every stage until they reach the end of the route and pass through the finish line in each of the seven stages, and only within the track of the official route planned by the organization. Obviously, these insurances included within the inscription do not cover any mishap that may happen in which a participant could be involved outside the strict scope of the cycling stage or the track delimited by the organization.

The detail of the insured capital by this policy will be reported later in this same section of the Participating Area.

In order for the organization to cover all participants with these insurances, these participants must accept to provide if necessary all that information and personal data that the insurance company may require.

OTHER INSURANCE AT THE PARTICIPANT’S WILL AND THEIR VALIDITY IN TRANSPYR COAST TO COAST:

Participants can complete the insurance included by the organization or have other alternative insurance if they consider it interesting or convenient, such as medical insurance or travel insurance they deem appropriate and that can cover any situations not included in the compulsory insurance such as accidents outside the course of the stage or transfer to the country of origin in the case of cyclists coming from outside the Spanish state.

In this context, it is very important to inform that the participant is solely responsible for verifying the validity of these complementary insurance policies freely contracted by him in the context of the TRANSPYR COAST TO COAST 2019 event.

In any case, from TRANSPYR COAST TO COAST all participants are advised and informed to inform the RACE OFFICE of the organization as soon as possible of any mishap in which they have been involved in the course of a stage, either of a fall, accident or incident with third parties that could lead to a need to use the insurance coverage included in the registration (see ACTING PROTOCOL below).

MEDICAL SERVICE PROVIDED BY TRANSPYR COAST TO COAST

The medical service provided by TRANSPYR COAST TO COAST 2019 covers first aid and medical care during the course of the stage.

This medical service is therefore present from the moment that participants start each of the seven stages until all the participants who take part in the event have crossed the finish line of each of the seven stages, attending to the accidents and medical care needs that occur within the official itinerary determined by the organization.

When the last participant has reached the finish line of each stage, the medical service ends its work.

In case that a participant has a medical need after reaching the finish line –such like gastroenteritis, sores, fever, trailing injuries, etc- he or she should go to a local medical center or the local hospital and use their own sanitary coverage or personal insurance that is opportune to receive such attention.

In this hypothetical situation, the organization will help the participant to contact the local medical services, but the participant will have to organize himself (transport, handling with their personal insurances, if necessary, payment of the service, etc).

ACTING PROTOCOL IN CASE OF ACCIDENT OR INCIDENT WITH THIRD PARTIES

The most important and determining point to take into account is that in order to use the coverage in terms of medical assistance or liability of the compulsory sports insurance included in the registration, the personal accident or incident with third parties must have taken place within the course of one of the seven stages and within the official route planned by the organization, and must also have been notified and left a written record of it in the RACE OFFICE of the organization within the next 12 hours that this personal accident or this incident with third parties toke place.

If in the course of a stage a participant requires the official medical service of the organization, this medical service will make a first assessment and if necessary will proceed either to provide medication, perform a cure, or refer the injured to the medical center or hospital that the medical service considers the most appropriate in that situation; attending to the criterion of the person in charge of the service. In any case, the care provided by the official medical service of the organization must always be recorded in order to be able, if necessary, to activate the insurance benefits included in the registration, and it is especially important for those cases in which a transfer to a medical center and / or a subsequent convalescence could be necessary.

Only in cases of emergency, the official medical service of the organization itself could inform RACE OFFICE of the accident to record it.

In addition, when a participant suffers an incident -fall, injury, health problem- during a stage that prevents him from continuing on the road (and this incident does not require the transfer by the means of the official medical service), the organization also ensures its transfer to the finish line village of said stage.

If for any reason, a participant has had to receive medical attention as a result of an accident in the course of a stage without going through the official medical service, this participant also undertakes to record this to RACE OFFICE of the organization before 12 hours of the accident are met for an eventual activation of the insurance benefits.

In the event that a participant of TRANSPYR COAST TO COAST suffers or is the protagonist or intervenes in an incident with third parties during a stage that may require the intervention of liability insurance, this participant is obliged to record this a RACE OFFICE of the organization before 12 hours of the incident are met for an eventual activation of insurance benefits.

Within this assumption, for example, the damages caused or suffered between participants, or the damages caused to people outside the cyclist’s event, or the damages caused to properties and things present in the course and in the course of a stage of TRANSPYR COAST TO COAST that could give rise to a claim by the injured party.

VERY IMPORTANT: the organization will not be responsible for processing or dealing with any aspect related to the coverage of accident or civil liability insurance that has not been duly communicated to it by the involved participant.

LUGGAGE

You will receive a free luggage sack with a plastic bag where you will place your dorsal number. This bag should be used for personal belongings -what you need after each stage -, and will be moved by the organization from stage to stage. It must also be used to store the sleeping bag and mattress in case you’ve chosen to sleep in the common dormitory: TranspyrCamp.

Remember that the weight limit is 20 kg, The bag must be tightly closed and should not take anything tied out. The Transpyr bag measures are 80x30x30.

You can organize your things at home and when you get to Roses, you move them from your private case to the participant bag given by the organization.

And, what do you do with your bike box or private case where you have taken all your belongings to Roses, once empty? Different solutions:

  • If you have some relatives there, you can leave it with them.
  • If you park your car in Roses, you can leave it in the car.
  • If you came by plane or train and  you take the transfer bus from Hondarribia back to Roses or Barcelona or if you are leaving from Hondarribia directly, we will transport it there and will be at the finish area when you arrive at the very end of Transpyr.
  • In this latter option, the case will stay in Roses until the penultimate day when transported to Hondarribia for you to have the day of arrival. If for any reason a participant must leave the event halfway it will have to go find his suitcase in in Roses.

For those who are staying in motorhomes or in hotels and have not booked the Transpyr pack hotel, we need you to fill the form “Accomodation” that you will find in “personal data” in your particpant area,  in order to let us know if you want your luggage to be transported or not and if affirmative, in what hotels will you stay to ensure the delivery. During the event you will have to pick up and leave the luggage at the reception of the hotel (we don’t pick up or deliver in the rooms).


We remind you that the organization will only carry luggage to and from those hotels in the stage town city core (except Burgete where we offer the service in Burguete, Roncesvalles and Espinal). If you are staying out of the town, your luggage will be delivered at the Transpyr Camp and you are supposed to organize carrying the luggage to your hotel.

In case that you change your lodgment in one of the stages or that your supporters carry your luggage in one or more stages, this information should be transfered to Race Office.

There will not be luggage transportation to the hotel in Roses on the accreditation day. We start the service collecting the bags on starting day.
There will not be luggage service in Hondarribia once the event is already over.

For participants staying at hotels from the TRANSPYR HOTEL PACK, they should leave the bag in the inidcated place by the hotel, one hour before the start of the stage, otherwise the organization is not responsible of the transport of this lugagge.

For those who are staying in the TranspyrCamp during the week, each morning, they must carry themselves the bag to the vehicles that will be stationed at the entrance of the facility.

ATTENTION: THE MAXIMUM WEIGHT IS 20 KG FOR BAG and THE BAG MUST BE TIGHTLY CLOSED AND SHOULD NOT TAKE ANYTING TIED OUT. All bags not complying this requirements will be left at the race office and the participant has to carry to his/her accommodation.

IT IS ABSOLUTELY FORBIDDEN TO CARRY DANGEROUS, FLAMMABLE OR ILLEGAL PRODUCTS. We remind you that we can not be responsible for any valuable object inside the luggage, either by rupture or disappearance .

BIKE and TECHNICAL SERVICE

Your bike – organization advises

TRANSPYR is not only hard for the rider, it is also a challenge for your bike: More than 100km and 2500m of daily vertical climbing on all types of roads, trails and areas, from very soft (asphalt) to very broken and demanding, and to this it must be added the effect of variable weather conditions as high temperatures, dust, water, mud, clay, sand etc…

For the organization, it is not viable or achievable to be everywhere and have all kinds of parts / components and tooling for all bike models for each of the 400 participants. Besides it, it is not his work dealing with mechanical aspect as this is a task for specialists. These are the reasons why the organization, as stated in all rules and regulations of TRANSPYR, DOES NOT PROVIDE ANY SUPPORT BEFORE, DURING OR AFTER EACH STAGE.

This is an event where the participant is responsible for his/her bike and therefore its repairing and maintenance. For those who want to guarantee the efficient mechanical work and avoid spending more time with it after biking near 8 hours, THE ORGANIZATION RECOMMENDS THE HIRING OF MECHANICAL SERVICE (see below).

If you have no experience in events like TRANSPYR, learn and get advice from your store or network of experts on the characteristics, preparation or specific tuning of your bike to cover 7 consecutive stages on all types of terrain.

For our part, although we don’t want to be exhaustive or experts, we recommend you to consider:

1.-daily control: you should avoid at all costs, mechanical mishaps as a result of a fall or a bad functioning of the bicycle or the inadequacy of its characteristics to the event. To do this we recommend a daily check of your bike.

2.- saddle and pants: do not try new garments during TRANSPYR. You must use a combination of clothing and saddle you have proved before. Problems with blisters arise very often and normally they disappear afterwards… if treated correctly

3 .- position on the bike: attention to suffering pain in the neck, hands and arms that can be derived from remaining with the driving position for many hours, day after day. Sometimes they are a result of small pinched nerves or muscles in the palm of the hand, etc. A caution, apart from a correct driving position is using good padded gloves with gel in the area of contact.

4 .- wheels: you must use wheels sufficiently rigid and strong. For the latter, perhaps it is more advisable a good ball, but a little rolling ballast, which will be less vulnerable to pinching and further protect the tires, and be more comfortable while providing better grip and safety. It is very important to provide spare parts for punctures and above all to install some element (liquid, protective strip etc.) to avoid the spikes very present in certain parts of the route.Because of the variety of terrain and climate of this winter is difficult to advise a specific type of tire. In any case we would be inclined by a versatile design, but if you can afford it, take a tire for dry, rocky conditions and one for muddy conditions.

5. – specific replacement: there are some specific parts susceptible to breakage or being consumed during TRANSPYR, and it is recommended to dispose of them and always carry with yourself. We refer for example to the “pin” of change, wheel spokes, brake pads, etc. You can ask your mechanic about which parts to wear and also consult the list of items that the organization recommends to take during each stage.

  Mechanical Service

The need to have solved the control and possible repair of your bicycle is a crucial aspect to consider.

The mechanical service will be offered by external providers, and the links to them will be available on the label “services” of your participant area.

The difficulty in organizing an efficient and quality service for a wide variety of brands and models of bicycles, in July and in an environment like the Pyrenees, forces the need to know which brands and how many bikes may need this service and then organize a proper sizing of mechanical, components and consumables. This is why the hiring of this service is needed before May 15,.

Additionally we will provide an area of self-workshop, consisting of a light structure of carp + workshop + bike hanging structure + pump, pedalwrench and allen wrenches for free use to any participant in TRANSPYR

During the tour participants must be mechanically self-sufficient. In cases of failure during the race, when the participant cannot fix and cannot follow the race, the participant will have to jump into the safety car and, later on, try to repair the problem at the stage town or, if he/she has hired the mechanical service, bring the bike to the work shop. In this case he/she can continue the march the day after but cannot be held FINISHER.

Bike wash

The organization organizes an area to wash your bike. The organization will put the, machines and cubes, but you must bring disposables / consumables (degreasing, lubricants etc.).
